Terms of Service

Last updated: May 23, 2026

Plain-English summary

  • We are a marketplace. MBMT Incorporated runs the technology that connects you with independent local service providers. We do not move, deliver, clean or assemble anything ourselves.
  • Your contract is with the provider. When you book through us, you are hiring an independent business directly. They are responsible for performing the service and for anything that goes wrong on the job.
  • We help you choose. We show verification badges (background check, business insurance, cargo insurance, local incorporation) where the provider has opted in and supplied documents. These badges are informational, not a guarantee.
  • You decide. You can pick a verified provider or any other listed provider. We sort verified providers higher and flag un-verified ones so you can make an informed choice.
  • This summary is not the full agreement. The full terms below govern your use of our platforms.

These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and related services operated by MBMT Incorporated ("MBMT", "we", "us" or "our"), a corporation incorporated in Canada, including but not limited to the following platforms (each, a "Platform" and collectively, the "Platforms"):

  • vandeliveryapp.com
  • 49van.com
  • madeleinemaids.com
  • uloadit.ca
  • metromoves.ca
  • cargovan.ca
  • mymovingservice.com
  • happydelivery.ca
  • ugetthetruck.com
  • curbload.com

By accessing or using any Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platforms.

1. Nature of the Platform

The Platforms are online marketplaces that enable customers to submit service requests, receive quotes, communicate with independent service providers, and book moving, delivery, transport, courier, labour, assembly, cleaning, junk removal, handyman, landscaping, and related local services.

MBMT does not itself provide moving, transport, delivery, packing, loading, unloading, storage, freight, courier, cleaning, assembly, handyman, landscaping, repair, or logistics services. All such services are performed by independent third-party service providers using the Platforms.

2. MBMT's Role

MBMT's role is limited to operating the Platforms and the related technology infrastructure (including search, matching, quoting, scheduling, communications, payment processing, identity and document intake, customer support tooling, and dispute mediation tooling). MBMT is not a carrier, moving company, transport operator, freight forwarder, warehouse operator, logistics provider, packer, cleaner, contractor, employer, or insurer.

All services booked through the Platforms are provided by independent third-party service providers ("Service Providers"), not by MBMT.

3. Contract for Services

When a customer accepts a quote or confirms a booking through a Platform, a contract for the relevant services is formed directly between the customer and the relevant Service Provider. MBMT is not a party to that contract. The relevant Service Provider is solely responsible for performing the booked services.

4. Independent Service Providers

Service Providers using the Platforms operate independently and on their own behalf. No Service Provider is an employee, agent, partner, joint-venturer, representative, franchisee, or sub-contractor of MBMT. Nothing in these Terms or in the operation of the Platforms creates any agency, employment, partnership, joint venture, fiduciary, or representative relationship between MBMT and any user or Service Provider.

5. Verification Badges & No Guarantee

The Platforms may display verification badges, trust indicators, ratings, reviews, response scores, and similar information about Service Providers, including:

  • whether the Service Provider has passed an MBMT-arranged background check;
  • whether the Service Provider has supplied documentation evidencing local incorporation as a registered business;
  • whether the Service Provider has supplied documentation evidencing business liability insurance;
  • whether the Service Provider has supplied documentation evidencing cargo insurance, commercial auto insurance, or other business-related coverage; and
  • any other verification or trust indicator displayed on the Platforms from time to time.

These badges and indicators are informational only and are based on documents and disclosures supplied by the Service Provider at a particular point in time. MBMT does not guarantee, warrant, or assume responsibility for the ongoing accuracy, validity, scope, sufficiency, or in-force status of any background check, licence, registration, insurance policy, or coverage. Insurance and licensing requirements vary by jurisdiction and by service type; customers are encouraged to make their own enquiries and to request supporting documentation from the Service Provider directly before or at the time of service.

MBMT also does not guarantee that any Service Provider is suitable, available, licensed where required, qualified, reliable, punctual, or solvent; that any quote is accurate, complete, final, or appropriate; that any booking will proceed as requested or quoted; or that any goods, items, or premises will be transported, handled, serviced, or treated without delay, loss, theft, deterioration, or damage. Any vetting, profile approval, review, rating, badge, response score, or account status shown on the Platforms is for Platform purposes only and does not amount to a representation, warranty, guarantee, or assumption of responsibility by MBMT.

6. Optional Vetting; Display of Un-vetted Providers

Vetting through MBMT is optional for Service Providers. Providers who choose not to complete the background check or who do not supply insurance, incorporation, or other supporting documents may still appear on the Platforms but will be flagged as un-verified and will typically be ranked after verified providers in search and matching results. Customers are advised to take the verification status displayed against a Service Provider into account when making a booking decision.

7. Accounts

Users must provide accurate, current, and complete information when registering and must keep their account details secure. You are responsible for all activity carried out through your account. MBMT may suspend, restrict, or terminate any account, service request, quote, message, booking, or access to the Platforms at any time if MBMT reasonably considers it necessary for fraud prevention, risk management, regulatory compliance, safety, Platform integrity, reputational protection, dispute management, or any breach of these Terms.

8. Service Requests and Information

Customers must ensure that all information provided in a service request is accurate, complete, and not misleading, including pickup and delivery locations, dates, item descriptions, quantity, size, weight, volume, access conditions, fragility, special handling requirements, pets present at the site, parking restrictions, and any other relevant detail. MBMT is not responsible for checking or verifying service-request information.

If any information in a service request is inaccurate, incomplete, or misleading, the Service Provider may revise the quote, impose additional charges, refuse to proceed, delay the booking, or cancel the service. Any consequences arising from inaccurate or incomplete information are the customer's responsibility.

9. Quotes

Quotes shown through the Platforms are generated by or on behalf of Service Providers and are based on the information supplied by the customer. If the actual job differs from the information supplied, a quote may no longer apply. MBMT is not responsible for quote accuracy, repricing, pricing disputes, or any additional charges raised by a Service Provider.

10. Payments

Where MBMT processes payments on behalf of a Service Provider through a third-party payment processor (such as Stripe), MBMT does so solely as a limited payment facilitator for the convenience of users. The underlying obligation to pay for the service is between the customer and the Service Provider. MBMT does not hold customer funds in trust or escrow for the benefit of any party, except where required by applicable law.

MBMT may charge Service Providers separate platform fees, subscription fees, background-check fees, or other fees for use of the Platforms. Any account top-ups, prepaid credits, gift cards, referral credits, or similar amounts added to a Platform account are non-refundable, except where MBMT expressly agrees otherwise in writing or where refund is required by applicable law.

11. Cancellations and Changes

Bookings may be changed, delayed, cancelled, or refused by the customer or the Service Provider. Any cancellation policy, late-cancellation fee, waiting charge, wasted-journey fee, redelivery fee, or similar charge is a matter between the customer and the Service Provider unless MBMT expressly states otherwise. MBMT is not responsible for losses arising from cancellation, rescheduling, no-shows, failed collection, failed delivery, delay, lack of access, unsafe conditions, undisclosed items, or inaccurate booking information.

12. Service Provider Responsibility

Each Service Provider is solely responsible for:

  • the services it offers and performs;
  • compliance with applicable laws, regulations, licences, permits, by-laws, and safety requirements (including but not limited to provincial commercial-vehicle, worker-safety, and consumer-protection laws);
  • its vehicles, labour, sub-contractors, equipment, tools, and supplies;
  • deciding whether items or premises are accepted for the booked service; and
  • any complaint, claim, refund, delay, damage, loss, injury, or dispute relating to the booked service.

MBMT does not assume any of those responsibilities.

13. Restricted or Prohibited Items

Customers must not request the transport, handling, storage, or disposal of unlawful, hazardous, unsafe, prohibited, or improperly packed items. Service Providers may refuse to handle any item they consider unsafe, unlawful, unsuitable, or not as described. MBMT is not responsible for inspecting items or determining whether items are lawful, safe, properly packaged, or suitable.

14. Packaging, Access, and Readiness

Unless expressly agreed otherwise between the customer and the Service Provider, the customer is responsible for ensuring that items are properly packed and ready for transport, that pickup and delivery access (including parking, elevators, stairs, doorways, and gates) is safe and adequate, and that any required permissions, permits, or building arrangements are in place. MBMT is not responsible for damage, delay, extra cost, or non-performance arising from inadequate packaging, unsafe or restricted access, customer delay, weather exposure, or site conditions.

15. Loss, Damage, Delay, and Non-Performance

Any loss, damage, theft, deterioration, delay, missed timing, failed delivery, failed collection, partial delivery, non-delivery, property damage, personal injury, or other service issue arising out of a booking is solely a matter between the customer and the relevant Service Provider. To the maximum extent permitted by law, MBMT is not liable for any such matter and is not responsible for investigating, compensating, insuring, or resolving it.

16. Insurance

MBMT does not provide insurance for any goods, vehicles, pets, equipment, real property, or other items listed, booked, or handled through the Platforms. Any insurance held by a Service Provider is a matter between the customer and that Service Provider. Customers are responsible for making their own enquiries about insurance and arranging any additional insurance they require (for example, tenant's contents insurance, valuation coverage, or all-risk transit cover). MBMT makes no representation that any insurance disclosed by a Service Provider exists at the time of service, is adequate, or will respond to any particular claim.

17. Reviews, Ratings, and Content

The Platforms may display reviews, ratings, profile details, response times, account history, verification status, badges, and similar information. MBMT does not guarantee that such information is accurate, complete, representative, current, or free from manipulation. MBMT may remove, edit, suppress, reorder, or decline to publish any content at its discretion. Users grant MBMT a non-exclusive, worldwide, royalty-free licence to use, reproduce, store, publish, modify, and display content submitted through the Platforms for operating, improving, promoting, and protecting the Platforms.

18. Communications and Platform Monitoring

Users agree that MBMT may send operational, support, transactional, and marketing communications (subject to opt-out where required by Canadian anti-spam laws including CASL). Users also agree that MBMT may store, review, analyse, and use communications and records relating to Platform activity for fraud prevention, support, quality control, moderation, compliance, dispute management, evidence, Platform improvement, and legal protection. MBMT may use automated systems and AI-assisted tools in connection with customer support, moderation, fraud detection, reminders, follow-ups, and general Platform operations.

19. Privacy and Personal Information

MBMT collects, uses, stores, and processes personal information in accordance with applicable Canadian privacy laws, including the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and provincial equivalents where applicable. Users are responsible for ensuring that any personal information they provide to MBMT or through the Platforms is accurate and that they are entitled to provide it. Refer to our Privacy Policy for further detail on how personal information is handled.

20. Disputes Between Users

Any dispute relating to a booking or service is between the customer and the relevant Service Provider. MBMT may, but is not obliged to, assist with communications, request information, mediate informally, remove content, or make Platform-level decisions for risk or operational reasons. Any such involvement does not make MBMT a party to the dispute and does not create any duty for MBMT to investigate, adjudicate, resolve, reimburse, or compensate.

21. Prohibited Conduct

Users must not:

  • provide false, misleading, or fraudulent information;
  • manipulate quotes, reviews, ratings, search rankings, badge status, or Platform outcomes;
  • misuse, copy, scrape, harvest, or commercially exploit Platform data or content;
  • create fake accounts, service requests, or quotes;
  • use the Platforms unlawfully, abusively, harassingly, fraudulently, or in a way that harms MBMT or other users; or
  • bypass or attempt to bypass MBMT in a way intended to avoid applicable fees owed by Service Providers (sometimes called "circumvention").

MBMT may take any action it considers appropriate in response to such conduct, including suspension, termination, content removal, fee recovery, charge-back of platform fees, and legal action.

22. Indemnity

You indemnify MBMT and its related entities, affiliates, directors, officers, employees, contractors, and agents against all claims, demands, liabilities, losses, damages, costs, penalties, and expenses (including reasonable legal fees on a solicitor-and-own-client basis) arising out of or connected with: your use of the Platforms; your breach of these Terms; your service request, items, content, conduct, or communications; any dispute between you and another user; and any claim arising from services booked through the Platforms.

23. Limitation of Liability

To the maximum extent permitted by law, MBMT is not liable for any loss, damage, cost, or claim arising out of or in connection with the Platforms, any booking, or any services booked through the Platforms. If MBMT is found liable for any reason, its total aggregate liability is limited to the greater of (a) the amount of platform fees actually paid to MBMT in connection with the relevant booking and (b) CAD $100. MBMT is not liable for any indirect or consequential loss, including loss of income, profit, business, goodwill, reputation, opportunity, or expected savings.

24. Release

To the maximum extent permitted by law, each user releases MBMT from any claim, action, liability, loss, or demand arising out of or connected with: the acts or omissions of another user; any booked service; any quote, cancellation, delay, dispute, damage, loss, theft, injury, or non-performance; or any inaccuracy in user information, reviews, ratings, profile details, badges, or insurance-related information.

25. Consumer Law

Nothing in these Terms excludes, restricts, or limits any right or remedy that cannot lawfully be excluded, restricted, or limited under applicable Canadian consumer-protection legislation. If you are a consumer, your rights under your provincial consumer-protection statute may apply in addition to (and override where mandated by law) the terms set out in this document.

26. Electronic Communications

You agree that notices, disclosures, records, agreements, and other communications may be provided electronically through the Platforms, email, SMS, in-app message, or other electronic means permitted by law. Electronic agreements and signatures may be used to show identity, intent to sign, and agreement to be bound.

27. Changes to the Platforms and Terms

MBMT may modify, suspend, withdraw, or change any part of the Platforms, their features, or these Terms at any time. Updated Terms take effect when published on the Platforms. Continued use of the Platforms after updated Terms are published constitutes acceptance of the updated Terms.

28. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, except where mandatory provincial consumer-protection law applies. Subject to any mandatory rights that cannot be excluded, the courts of the applicable Canadian province or territory have non-exclusive jurisdiction in relation to any dispute arising out of or connected with these Terms or the Platforms.

29. Contact

Questions about these Terms may be sent using the contact details published on any of the Platforms, or by emailing info@mbmtinc.com.

These Terms are a working draft prepared for MBMT Incorporated. They are intended to be reviewed by qualified Canadian counsel before being used as binding terms in production. Capitalised terms not defined in this document have their ordinary meaning.

VanDeliveryApp is an online marketplace operated by MBMT Incorporated that connects customers with independent local service providers. Providers are independent local businesses — not MBMT employees.
